When life-threatening injuries become tragic, life-ending injuries, South Carolina law provides that a Wrongful Death action may be brought against those whose negligent or willful conduct is responsible. The purpose of a Wrongful Death claim is to recover compensation for the benefit of the spouse, children, or heirs of the victim. The estate of the victim may also be entitled to recover separate damages under South Carolina's "Survival Statute", S.C. Code 15-5-90. These damages are intended to compensate for pain and suffering endured by the victim prior to death. Beneficiaries under the Survival Statute and may or may not be the same persons as Wrongful Death beneficiaries.
